Terms of Service
By using HamptonsYardSales.com you agree to the terms below. We have tried to keep them in plain English. They cover how the site works, what we ask of you, and what you can expect from us.
1. About these Terms
These Terms of Service (the “Terms”) form an agreement between you and HamptonsYardSales.com (“we,” “us,” or “our”) governing your use of our website, mobile experience, and related services (collectively, the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. Who we are
HamptonsYardSales.com is a free community directory that helps people across Eastern Long Island find and list yard sales, estate sales, garage sales, and similar local events. You can reach us any time at hello@hamptonsyardsales.com.
3. Eligibility
You must be at least 18 years old to create an account or submit a listing. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
4. Accounts
You can browse much of the Service without an account. To submit a listing, save sales, or use other interactive features, you will need to sign in. We use a third-party authentication provider to handle sign-in and password management. You are responsible for keeping your sign-in credentials secure and for all activity that takes place under your account. Please give us accurate information when you sign up and keep it current.
5. Listing rules
When you submit a yard sale listing, you confirm that the information you provide is accurate, that you have the right to host the sale at the address listed, and that you have the right to share the photos you upload. Listings should describe genuine, in-person sales open to the public.
The following are not permitted in any listing: firearms, ammunition, or weapons; live animals; alcohol, tobacco, or controlled substances; hazardous materials; counterfeit, stolen, or recalled goods; adult or sexually explicit content; anything unlawful to sell at a residential sale under New York law; and anything that misrepresents what is actually being offered. We may remove any listing that violates these rules or that we believe is misleading, harmful, or inconsistent with the spirit of a community yard sale.
6. Your content and the license you grant us
You keep ownership of the photos, descriptions, and other content you submit (“Your Content”). By submitting Your Content to the Service, you grant HamptonsYardSales.com a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt for formatting, and distribute Your Content for the purpose of operating, improving, and promoting the Service. This license ends when you remove Your Content from the Service or close your account, except for copies we reasonably need to retain in backups or for legal purposes.
You are responsible for Your Content. You represent that you own it or have all the rights necessary to share it with us, and that it does not violate anyone’s rights or any law.
7. Acceptable use
Please do not use the Service to: harass, threaten, or impersonate anyone; spam other users or the public; circumvent our security or rate limits; harvest or collect information about other users; introduce malicious code; or use automated tools to access, extract, or copy our content without our written permission. We may suspend or terminate access for anyone who breaks these rules.
8. Sales happen between hosts and visitors, not with us
HamptonsYardSales.com is a directory. We are not a party to any sale, transaction, or interaction that takes place at a listed event. We do not screen hosts or visitors, we do not inspect items, and we do not guarantee that a sale will take place as described or at all. Always confirm details with the host before traveling, and use common sense when meeting strangers and exchanging cash. Any dispute about a sale, an item, payment, or conduct at an event is between the people involved.
9. Where our listings come from
Listings on the Service come from two places:
Host-submitted listings are posted directly by the seller through our submission forms. The host is responsible for the accuracy of the listing and confirms they have the right to host the sale at the address provided.
Publicly available listings are yard sale postings that have already been made public elsewhere on the web. We compile them, summarize and clean up the formatting (sometimes with the help of automated tools), and present them here so the community has one place to find local sales. Where possible we link to or credit the original posting. We do not claim ownership of these underlying listings, and we work to keep details accurate but cannot guarantee accuracy. If you originally posted a listing that appears on our site and would like it removed, email us at privacy@hamptonsyardsales.com and we will remove it promptly, typically within a few business days.
10. Partner placements and sponsored content
Some areas of the Service may include paid placements from local partners — for example, local businesses, real estate professionals, or community sponsors. Our partners pay us for these placements. Paid placements are clearly identified as such (for example, with a “Presented by” or “Sponsored” label). A paid placement is not an endorsement of the partner by HamptonsYardSales.com.
11. Intellectual property
The Service itself — including the site design, our brand name and logos, the organization and presentation of listings, and the software that runs the site — is owned by HamptonsYardSales.com and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms or by applicable law.
12. Copyright and takedown requests
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to legal@hamptonsyardsales.com that includes: (a) your contact information; (b) a description of the copyrighted work; (c) the URL or location of the allegedly infringing material; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf; and (f) your physical or electronic signature. We may remove material we believe in good faith infringes a valid copyright.
Counter-notification. If your content has been removed in response to a copyright notice and you believe the removal was a mistake or that you have the right to use the material, you may send us a counter-notification at the same address. The counter-notification should include: your contact information; identification of the material that was removed and where it appeared on the Service before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your consent to the jurisdiction of the federal or state courts located in Suffolk County, New York; a statement that you will accept service of process from the party who sent the original notice; and your physical or electronic signature.
Repeat infringers. We will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
13. Removing listings and accounts
You may remove your own listing or close your account at any time by signing in or by contacting us. We may remove any listing, suspend any account, or stop providing the Service to anyone, with or without notice, if we believe these Terms have been violated, if a listing is misleading or harmful, or if we are required to do so by law.
14. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HamptonsYardSales.com disclaims all warranties, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that any listing is accurate, that any sale will occur, that the Service will be free of errors or interruptions, or that any defects will be corrected.
15. Limitation of liability
To the fullest extent permitted by law, HamptonsYardSales.com and its operators, owners, employees, contractors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Service or these Terms is limited to the greater of one hundred U.S. dollars ($100) or the amount you have paid us in the twelve months before the claim. Nothing in this section limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited or excluded under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless HamptonsYardSales.com from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: your use of the Service; Your Content; your breach of these Terms; or your violation of any law or third-party right.
17. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You and HamptonsYardSales.com agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the jurisdiction of those courts.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If the changes are material, we will also try to give you reasonable notice — for example, by posting a notice on the site or, where appropriate, sending an email. Your continued use of the Service after the updated Terms take effect means you accept the changes.
19. Other terms
If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Sections 6 (your content and the license you grant us), 11 (intellectual property), 14 through 17 (disclaimers, limitation of liability, indemnification, governing law and venue), and 20 (contact) survive any termination of these Terms or your use of the Service. These Terms, together with our Privacy Policy, are the entire agreement between you and HamptonsYardSales.com regarding the Service.
